Welcome to Tutorina

Thank you for using our products and services ("Services"). By using our Services, you agree to these Terms and Conditions. Please read them carefully.

Our Services are dedicated to parental control, which also involves the processing of minors' data; therefore, additional Terms and Conditions or additional product requirements may sometimes apply, which will be promptly made known to you before you access these products. In case of certain Services, which will be expressly mentioned by Tutorina, there may be Additional Terms and Conditions, and, if you use those Services, those Additional Terms and Conditions may form part of the contract between Tutorina through the TUTORINA PLATFORM, which also collects, by agreement, your child's data.

Use of our Services

You must abide by all policies made available within the Services.

Your use of the Services does not give you any intellectual property rights in the Services or the content you access. As a Tutorina user you can access/purchase information services, screen time management services and support services. You are not entitled to use the content within our Services except as a user of our Services.

If our Services display content that does not belong to Tutorina, the responsibility for such content rests solely with the entity making it available. In connection with your use of the Services, we may send you service announcements, administrative messages and other information. You may opt out of some or all of these communications by checking/unchecking them in your TUTORINA PLATFORM Account Settings.

When you start using Tutorina services you can choose whether or not to agree to Tutorina conducting user surveys, loyalty campaigns and promotional campaigns using your user account, email address or phone number, as a means of communication, unsubscribing can be requested at any time at the email address: contact@tutorina.com.

Your account on TUTORINA PLATFORM

In order to use Tutorina's services, an Account on the TUTORINA PLATFORM is required. By contracting the Tutorina system you become one of the following user categories: parent or minor.

The Tutorina Privacy Policy explains how we treat your personal data and how we protect your privacy when you use our Services.

Your content within our Services

Certain Services allow you to submit content. Tutorina manages the TUTORINA PLATFORM and the modules integrated in this platform.

Certain Services may provide you with ways to access and remove content provided to that Service. Also, certain Services have Terms and Conditions or settings that restrict the scope of use of content submitted to those Services. Please ensure that you have the necessary rights to access the appropriate modules for all content you submit to our Services.

You can learn more about how Tutorina uses and stores content in the Privacy Policy or in the Additional Terms and Conditions for certain Services that will be made available to you on the dedicated website. If you submit feedback or suggestions about the Services, we may use such feedback or suggestions without violating personal data protection laws.

About software programs within the Services

You may not copy, modify, distribute, sell or rent any part of the Services and the included software programs. You may not reproduce or attempt to extract the source code of that software program unless you have our written permission.

Modification and Termination of Services

We are constantly changing and improving our Services. We may add or remove functionality or features and such changes will be notified in advance so that the provision of the Services to you is not affected.

Warranties and disclaimers

We provide the Services at a commercially reasonable level of skill and care, with respect for data security, integrity, and privacy, and we hope you enjoy using them.

Responsibility for our Services

Tutorina will in no event be liable for any loss or damage.

Billing, Pricing and Payment Terms

This section contains information about Tutorina’s billing policies, pricing, and payment terms.

A. Billing Policies

If you choose to use the Subscription Features, you agree to the prices and payment terms displayed at the time of subscription. SABS Innovation SRL may introduce new features for which additional fees will be charged or may modify the rates and costs of existing services at any time. Any changes to prices or payment terms will apply starting from the next billing cycle.

Tutorina is not responsible for mobile data consumption resulting from the use of the Services. For questions related to billing, please consult your mobile and internet service provider, as there may be charges and limits for data rates.

B. Pricing and Payment Terms

1. Subscription Fees; Auto-Renewal

All subscription fees, including any applicable taxes and additional charges (referred to as the "Subscription Fee"), must be paid in advance, at the beginning of the subscription period and at the start of each subsequent billing cycle, according to the then-current Subscription Fee.

You have the option to pay the Subscription Fee on a monthly basis ("Monthly Subscription") or annually ("Yearly Subscription"). Your subscription will automatically renew until you cancel it. If you have a Monthly Subscription, you will be automatically charged each month on the anniversary of the start of your Monthly Subscription, using the payment information you provided, until you cancel your Monthly Subscription. If you have a Yearly Subscription, you will be automatically charged annually on the anniversary of the start of your Yearly Subscription, using the payment information you provided, until you cancel your Yearly Subscription. For Yearly Subscriptions, we will send you a reminder at least thirty (30) days before each renewal, with the then-current Subscription Fee. We may send additional reminders for other types of subscriptions as needed. We reserve the right to change Subscription Fees for Monthly and Yearly Subscriptions. We will provide you with advance notice of any increase in the Subscription Fees applicable to your subscription.

If you change your subscription, the billing date may be adjusted. If you switch from a Monthly Subscription to a Yearly Subscription, you will be charged according to the then-current Subscription Fee for a Yearly Subscription at the next billing date, and it will renew annually. If you have the option to switch from a Yearly Subscription to a Monthly Subscription and choose to do so, at the next renewal date of your Yearly Subscription, you will be charged according to the then-current Subscription Fee for a Monthly Subscription, and it will renew monthly.

If you purchase a Tutorina subscription, you can apply the features associated with that subscription to an additional parent in your Tutorina account, and those features will be available to all children linked to your account. Only the primary parent needs to purchase and apply the subscription. Tutorina is not responsible if multiple parents purchase separate subscriptions and apply them to the same linked children.

2. Free Trial Period

After initially signing up for a paid subscription, you may be eligible for a free trial period ("Free Trial Period"). You can cancel your account at any time during the Free Trial Period to avoid additional charges. You are limited to one free trial per person (credit card or other payment method or unique identification). If you do not cancel your account during the Free Trial Period, you will be automatically charged at the end of the period for the price of the account type selected during registration, and you will continue to be charged until you cancel the subscription. You can cancel a subscription at any time. Deleting the account from the app does not cancel the subscription. To stop recurring payments, you must cancel the subscription using the Apple App Store or Google Play Store portal, respectively.

By accepting a Free Trial Period, you agree that at the end of this period, you will be charged according to the applicable Subscription Fee for either a Monthly or Yearly Subscription, as specified in the Free Trial offer, and at the beginning of each subsequent billing cycle. You authorize us to charge you using the Payment Information provided when you accepted the Free Trial offer. We may validate the Payment Information and payment method by requesting a temporary authorization from the issuing financial institution. If we determine that the Payment Information or payment method is invalid, we may revoke the subscription and terminate the Free Trial Period.

3. Payment Methods

Tutorina subscriptions are purchased through the Apple App Store or Google Play Store. If Apple or Google cannot charge the provided card (e.g., due to the expiration of the credit or debit card), they will notify you to update your card information. You will have a grace period of 16 days on the App Store, 14 days for Yearly Subscriptions, and 7 days for Monthly Subscriptions on Google Play to update your billing information. If your account is not updated within the grace period, Tutorina may cancel your subscription.

Tutorina is not responsible for any fees or expenses you may incur as a result of charges billed by Tutorina under this Agreement (e.g., overdraft accounts or exceeding card limits). By providing a bank card number or another payment method with pre-authorization features, you authorize Tutorina to continue to charge the card for all costs due, including fees, until your account is settled and your subscription is terminated either by you or by Tutorina. Tutorina reserves the right to limit the number of accounts that can be charged to a credit card or another payment method or identification per unique user.

4. Pricing Changes

Subscription prices may be adjusted periodically to reflect inflation or changing business requirements. If this occurs and you have an active subscription, Tutorina will notify you in advance via email before the price change takes effect. If you do not wish to continue at the new price, you can cancel your subscription before the price increase becomes effective, following the instructions in the "Cancel Your Subscription or Close Your Account" section below.

C. Refunds

You can cancel your account at any time, in accordance with the "Cancel Your Subscription or Close Your Account" section. However, except as specified in the "Cancel Your Subscription During the Cooling-Off Period" section below or where prohibited by applicable law, no refunds will be issued for unused time on a subscription, for any license or subscription fees for any part of the Service, for any content or data associated with your account, or for anything else. After cancelling any features, your subscription will remain active and you will retain access to the features until the end of the current paid period. For example, if you purchase an annual subscription and cancel it after two months, you will not receive a refund for the remaining portion of the year, but you will be able to use the features for the remaining ten months you have already paid for.

D. Payment Information; Taxes

All information you provide in connection with a purchase, transaction, or other financial interaction with the Service must be accurate, complete, and up-to-date. You agree to pay all costs incurred by users of your credit card, debit card, or other payment methods used in connection with a purchase, transaction, or other monetary interaction with the Service, at the prices in effect at the time. You will pay any applicable taxes, if any, related to these purchases, transactions, or other monetary interactions.

Canceling Your Subscription or Closing Your Account

You can cancel your subscription or close your account at any time. To close your account, open the Tutorina app, go to My Profile, and tap on Delete Account.

Cancel recurring payments through the Apple App Store or Google Play Store to avoid future charges. To cancel your subscription, follow the steps below or contact us via email at contact@tutorina.com.

Android (Google Play Store):

  • On your Android device open your Google Play app.
  • Tap on your Profile Icon on the top right.
  • Tap on Payments & subscriptions.
  • Tap on Tutorina.
  • Tap on Cancel Subscription.

iOS (Apple App Store):

  • On your iPhone or iPad, open the "Settings" app.
  • At the top of the Settings menu, tap your name to access your Apple ID settings.
  • Tap "Subscriptions" to see a list of your active and expired subscriptions.
  • Choose the Tutorina Subscription.
  • Tap "Cancel Subscription" or "Cancel Free Trial." You might need to scroll down to find this option. Confirm your choice if prompted.
  • Follow any additional on-screen instructions to complete the cancellation process.

After cancellation, your subscription will remain active until the end of the current billing period, and you will not be charged further afterward.

If you send an email, include your name, the email address you used to register, and a phone number where you can be reached. Generally, it may take up to five (5) business days to process a cancellation request, so we recommend notifying us at least one week before the end of the current billing period. The cancellation will take effect at the end of that billing period.

Canceling Your Subscription During the Cooling-Off Period

If you are a consumer based in the European Union, European Economic Area, or United Kingdom, you have an automatic legal right to withdraw from contracts for paid subscriptions within fourteen (14) days from the date of purchase.

You have the right to withdraw from this contract within 14 days without providing any reason.

Google Play Store:

  • To cancel a subscription and request a refund during the reflection period, you must follow these steps:
    1. Access your Google Play account.
    2. Select the "Report a problem" or "Request a refund" option.
    3. Follow the instructions to complete the refund request.
  • Google Play Store will evaluate your request, and if approved, you will receive the refund to your bank account or the card used for the purchase.

Apple App Store:

  • To cancel a subscription and request a refund during the reflection period, the user must follow these steps:
    1. Access the "Report a Problem" site from Apple or your Apple ID account.
    2. Find the purchase for which you wish to request a refund.
    3. Select "Report a Problem" and follow the instructions to request the refund.
  • Apple App Store will evaluate your request, and if approved, you will receive the refund to your bank account or the card used for the purchase.

Refunds are subject to the refund policies of Google Play Store and Apple App Store.

We, as the app developer, do not directly manage the refund process. The refund will be processed by the app store from which the purchase was made.

About these Terms and Conditions

We may amend these Terms and Conditions and the Additional Terms and Conditions that apply to a Service, for example, to reflect changes in law or in our Services. Please check the Terms and Conditions from time to time.

We will post notices of changes to these Terms and Conditions on this page. We will post notices of changes to additional Terms and Conditions within the relevant Service. Changes will not apply retroactively and will be effective at least fourteen days after posting. However, changes related to new features of a Service and those for legal reasons will be effective immediately. If you do not agree to changes to the Terms and Conditions of a Service, we suggest that you discontinue the use of that Service.

  • In the event of a discrepancy between these Terms and Conditions and the Additional Terms and Conditions, the Additional Terms and Conditions shall prevail.
  • These Terms and Conditions govern the relationship between Tutorina and you. They do not create any rights for third-party beneficiaries.
  • If you do not comply with these Terms and Conditions and we do not take immediate action, it does not mean that we waive any rights we have (for example, the right to act in the future).
  • If certain terms and conditions are found to be unenforceable, this will not affect the rest of the Terms and Conditions.
